Today being Wednesday, 13th February 2019, the Code of Conduct Tribunal, CCT, have issued a bench warrant against the Chief Justice of Nigeria, CJN, Walter Onnoghen, for arraignment on Friday, February 15, 2019.
It also mandated the Inspector General of Police, Mohammed Adamu and the Director General, Department of State Services, DSS, Yusuf Magaji to effect his arrest.
This development was sequel to an application by the prosecuting counsel, Aliyu Umar praying the tribunal that a bench warrant be issued against Onnoghen whom he said has been consistently absent in order to compel his appearance.
According to Daily Post, Umar, argued that his application for a bench warrant was appropriate given that Onnoghen’s appearance today was the main reason upon which the last adjournment was approved.
But the defendant counsel, Adegboyega Awomolo made certain submissions citing the unresolved applications that must be done for purposes of fair hearing to his client, Onnoghen.
He said the issue of jurisdiction of the tribunal, its impartiality, ought to be resolved.
Further, he argued that the presence of his client in the eyes of the law was not mandatory unless during arraignment. But that the prevailing issues for determination was not for arraignment today.
However, the tribunal chairman, Danladi Umar after listening to the alternate submissions by the prosecuting and defence counsels ruled that Onnoghen be issued a bench warrant for his appearance on February 15.
